What's wrong with Rosseau's The General Will - Essay Example Rousseau spent most of his time observing the society and its organization. Through this, he realized how artificial and unfair aristocrats treated the common man. Years after intense thoughts and observation, he wrote a book, ââ¬Å"The social Contractâ⬠. In his book, he stated the origins of governments and their laws, arguing that no law was binding unless the people agree to it (Wraight 2009, p. 34). This book stimulated French thinking and became a driving force for the French revolution thirty years after its release. The general will The will can only direct the State forces to maintain its obligations, ââ¬Å"the common goodâ⬠, because if the resistance of the private interest makes it possible for societies to be established, then the harmony of the same interests makes it possible. The common thing between these different interests creates the social bond; and if there was no similar interest, then society could not have been formed. Therefore, the state should go vern the society only with this common interest. This quote comes from Rousseauââ¬â¢s book; the Social Contract.... Ideas on the general will There is always a common interest among conflicting parties Through voting, governments can generate the common interest that accommodates the needs of a majority of its citizens The majority may come up with a falsified general will Criticism of the general will Following these arguments of the general will, Rousseau contends that when rulers govern their societies according to the general will, the freedom of each individual is assured. This notion is untrue because the general will only takes the common good of a majority of citizens, which it assumes is the interest of each individual. Every individual in the society has unique interests that the general will cannot fulfill. Therefore, the general will offers a simple solution for governments to fulfill the major needs of the community where individual interests cannot be fulfilled. During voting, individuals consider their best interests before subordinating their personal wills to the general will. Whe n they fail to win, then the general will fails to fulfill their individual will. Rousseau admits that votes contribute less into making the general will, and that the uniting interest is a major contributor. It is then clear that the common uniting interest may fail to be the interest of each individual, and that is what makes the general will. Rousseau admits that there is a difference between the ââ¬Å"will of allâ⬠and the ââ¬Å"general willâ⬠He says that people do not always vote in ways that agree with the common interest due to social inequalities and related factors. Because of this, the will of all may disagree with the general will. In such circumstances, a law-giver comes up with a solution. Proponents of this type of legislations argue that the law should not bind people to help others since such a situation restricts peopleââ¬â¢s independence. Example: Tom was driving to town on a rainy afternoon, after driving for more than thirty minutes his car began heating up and huge white smoke began billowing from the bonnet of his car. Luckily, for him, the car had broken down some few meters to a bridge. He therefore alighted from his car and took a five litre water bottle which he had never travelled without from the trunk of his car and followed a small footpath that lead to the stream to fetch some water which could help cool his engine. He got to the stream, filled his container with the cold water, and began the short walk to where he had parked his car. However, a few meters from the riverbank, Tom heard hysterical sc reams emanating from the river, he turned and drowning in the river was a little boy probably seven years old. He immediately dived into the river without considering his actions, unfortunately, Tom had never swam before in a flowing water and it is only until he got into the water that he realized that he had made a mistake. He managed to grab the boy but the strength from the water current the weight of the boy overpowered him and before long, they were both drowning. It thus became a survival of the fittest situation; the boy was still alive and therefore held on to Tom tightly without letting go. Tom was fast losing breadth and he therefore needed to act swiftly to save his life or else they would both drown. In a sharp turn, he pushed the boy away from and fortunately managed to hold onto a root a few meters off the riverbank. The push from Tom combined with the strength of the water waves to give the boy a powerful thrust into a rock. The boy knocked his head and bled to death instantly. Just then, a group of young divers who had been tracing the boy from upstream arrived and one of the saw Tom push the boy away from him. They later removed the body from the water but a legal tussle was just to begin. Analysis The liability of omission begins when one decides to help in a desperate situation and later acts carelessly thereby causing a loss. In such a situation, the victim takes responsibility for his careless action. The law had not compelled Tom to try and save the boy, he could have simply looked at the young boy drown and continued with his business. In such a situation, he is acquitted from any liability since the law does not impose acts of humanity on the population. Had he left, Tom could have continued with his journey to the town and could not have answered to either the group of divers or the police. Additionally, should he have made a formal police report, he could have only been considered as responsible citizen and might therefore have appea red in the court only as a witness and helped the police with investigations to the best of his account of the event. The law does not command compulsory aid unless in special situations. By jumping into the water in an attempt to save the boy, Tom takes full responsibility of the boy and his subsequent acts of carelessness eventually result in the death of the boy. A life style change can occur or an empty wallet or purse I can almost expect someone will have when they first start driving a vehicle of their own. This impact in ones life can not only change their life style and their money situation but also there grades, sports, social life, and most of all their physical health. These advantages and disadvantages can be for the better but most of all the worst. In my opinion, owning a vehicle at a young age develops a good source of financial planning, responsibility, and awareness of what can happen to them if they become an uncontrolled driver. Next, with the purchase of a car there can be a life style change and also a huge financial decrease. If one owns a car, especially a teenager, they become cocky and act like a hot shot because they have a vehicle. With this problem a teen may start to develop a new driving style. They will drive with only one arm and will constantly change the CD player to different compact discs and radio station. With having them do this they will increase the chances of not paying attention to the rode and will cause an accident. So, a driver needs to keep their eyes on the rode to not only protect to their own life but the lives of others. Then, the new driver has already developed the bad habits of driving and this will lead them into a having bad grades, missing practices for sports, and lose a social life. The bad grades can come from driving too much, but if one drives, they will need a job. A job is where a loss in a social life comes together. If they are working to drive, they will not have enough time to spend with their friends. Now that they are trying to find time out of work to drive, hang out with friends, and play sports. Sports are after school each day. I dont expect a driver to play sports all week and only work two days and still have enough money to pay for their vehicle. Finally, the most difficult sacrifice to give up is their physical health being tampered with. By working all the time and constantly trying to join sports and hang out with friends this will affect their health. Where is their time to sleep? One will be doing it all but; they do need time to sleep. All of these advantages and disadvantages will change their entireà life style. I believe owning a vehicle will do that but in some cases a change is a good thing so there is always something to look out for. Change can be good but the time will keep ticking away. So, do what makes one happy and make it how you want it.
